Beijing housing lease contract model

In accordance with the provisions of the contract law of the People's Republic of China and the relevant regulations and regulations, the lessee and the real estate brokers shall, on the basis of equality and voluntariness, agree on matters relating to the housing tenant housing as follows:


Article 1 trust matters

Party B shall also provide the following services:


Second terms of commission


It is a new year.


Third live houses


After signing the contract, Party B shall accompany Party A to the house.


After party inspection, Party B (or / or) can charge a reasonable cost of house inspection to Party A, which shall not exceed $100 per time.

Party A has the right to refuse to pay the cost of house inspection if the premises sought by Party B for Party A fail to meet the requirements of Party A.


Fourth obligations of Party A


(1) identity cards, business licenses, and real certificate of identity should be presented.


(two) provide necessary assistance and cooperation to Party B's intermediary activities.


(three) the housing information provided by Party B shall be kept confidential.


(four) the lessor shall not engage in private pactions with the lessor introduced by Party B within the time limit of the entrustment and the expiry of the time limit; {page_break}

Fifth obligations of Party B


(1) a business license, a certificate of qualification of a real estate brokerage institution, etc. shall be produced.


(two) we should conscientiously complete the entrusted items of Party A, and seek the premises for Party A according to the conditions stipulated by Party A in accordance with the first clause of this contract, report the situation to Party A in a timely manner, and provide services such as liaison, assistance and match for the premises of the first party and the signing of the housing lease contract with the lessor.


(three) the housing information provided to Party A shall be verified in advance, and Party A shall meet the special requirements of the lessor.


(four) no false information, concealment of important facts or malicious collusion with others shall be allowed to harm the interests of Party A.


(five) we should ensure that the lessor has the certificate of ownership of the building, or other certificates of proof of ownership of rental housing, and the certificate of identity such as identity cards and business licenses.


(six) to collect the cost of seeing a house, necessary expenses and commissions, Party A shall issue a legal and standardized toll bill to Party A;


(seven) after the signing of this contract, Party B shall not collect any fees from any party in any form.

Sixth Commission


After the completion of the entrusted matter, Party A shall pay the Commission to Party B according to the actual monthly rent of 100%% (not more than).


The Commission shall be paid after the first party signs the rental contract with the lessor (within days / days).


Payment of commission: cash, cheque;


Party B shall not ask for payment of commission if the entrusted matter is not completed.


Seventh charges


The expenses of the intermediary activities shall be borne by Party B, and the house cost paid by Party A shall be deemed to be a commission.


Party B shall pay the necessary expenses to Party B if necessary because of the failure of Party B to cause the entrusted matters.


Eighth delegate


Party A (yes or no) allows Party B to delegate the entrusted matter to the third party.


Ninth conditions for rescission of this contract

Tenth liability for breach of contract


(1) if Party A fails to pay the Commission, the house cost and the necessary expenses, it shall pay the breach of contract according to the standard.


(two) Party A and Party B introduce private pactions to the lessor, and shall pay the penalty according to the standard of the company. If Party A and the lessor engage in private pactions, Party B has the right to obtain the agreed Commission.


(three) if Party A violates the obligation of confidentiality, it shall pay a breach of contract in accordance with the standard of {page_break}.


(four) if Party B provides false information, conceals important facts or has malicious collusion, it shall also compensate Party A for the losses it has received in addition to the refund of the commission already received.


(five) Party B's introduction to Party A that the lessor does not own the certificate of ownership of the building or the other certificate of the rental right of the rental housing according to the law or the certificate of the status of the owner, shall cause Party A's losses to be borne by Party B.

Eleventh solutions to contractual disputes


Disputes arising under this contract shall be negotiated or applied for mediation by the parties concerned. If negotiation or mediation is not resolved, the following two ways can be adopted to solve them:


(1) submit to the Beijing Arbitration Commission for arbitration;


(two) to have jurisdiction in accordance with the law.

Twelfth other conventions

This contract shall become effective after signing and sealing by both parties.

After the entry into force of the contract, the two parties shall make a written form of the change or supplement of the contract, as an appendix to this contract.
